  1. General Provisions

Unless expressly agreed otherwise in writing, all agreements, quotations and orders, and all deliveries of goods, services and contracting work resulting therefrom, are governed by the terms and conditions set forth below. These terms and conditions are accepted by the client by the mere fact of negotiating or concluding an agreement with Axion Invest NV or purchasing products through the web shop.

The client acknowledges to have taken note of these terms and conditions in all its written and printed provisions. He acknowledges that these terms constitute the integral text of the agreement reached between the parties and replace and annul all previous oral or written proposals or agreements, as well as any other communication made between the parties so far.

Any nullity of one or more clauses of these general terms and conditions, does not affect the applicability of all other clauses.

When an Axion Invest NV price offer is signed by the client, a complete and legally valid agreement is deemed to have been concluded. The same applies when the works are carried out after a price quotation has been sent to the client, except for immediate and registered protest after the commencement of the works.

 

Online Sales

The e-commerce website of Axion Invest NV, an NV with registered office at Damstraat 1, 3600 Genk, BE0872811146, and hereafter called AXION, offers its customers the opportunity to purchase the products from its web store online. This can be a session ticket, voucher, registration for a race, event or training.

These Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through AXION's online store, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other terms and conditions.

 

  1. Price

All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer. If delivery, reservation or administrative costs are charged, this will be stated separately. The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

 

  1. Offer

Despite the fact that the online catalog and e-commerce website are compiled with the utmost care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind AXION. As for the accuracy and completeness of the information offered, AXION is only bound by an obligation of means. AXION is in no case liable in case of manifest material errors, typesetting or printing errors. Consequently, Karting Genk cannot be held liable for direct or indirect damages resulting from the use of the information on this site.

If the information provided contains errors or if certain information on or via the site is unavailable, AXION will make every effort to rectify this as soon as possible. If you discover errors in the information provided through the site, you can contact the administrator of the site.

If the Customer has specific questions e.g. sizes, event or training fulfillment, availability, delivery time or delivery method, we request the Customer to contact our customer service department in advance: reservaties@kartinggenk.be
The offer is always valid while supplies last and may be modified or withdrawn by AXION at any time. AXION cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.

 

  1. Online purchases

The customer clicks on the desired product(s) and/or supplements in the web shop. This includes the product description, including any registration deadline. If necessary, the customer fills in the pilot and/or team names. Each driver who wants to kart or participate in an event must be registered in advance. The Customer who purchases products for third parties will ensure that these third parties are informed about the general conditions in force for the activities at Karting Genk, more specifically about the products for which he has purchased tickets.

AXION reserves the right to refuse unregistered visitors or to change or delete entered names at any time without giving any reason.

All selected products will be added to the shopping cart where the customer can modify, add or remove their selection as necessary. After this, the customer must validate the contents of his shopping basket after which a summary of the order becomes available. Next, the customer needs to log in or register in order to purchase the products. The next step includes the "payment and billing info. Where necessary, the customer should modify the information. To receive an invoice, the customer must enter the company name and VAT number in the payment and billing info. Failure to fill in these fields will result in the inability to create an invoice.
The data entered must be validated by the customer. To proceed to the payment window, the customer must check the 'Approve Terms and Conditions' box. The payment is securely processed by Ingenico e-payments. The customer has the choice between the following payment methods :
- via Bancontact & Ideal
- via VISA
- via Mastercard
- via Maestro


AXION is entitled to refuse an order due to a serious deficiency of the Customer in relation to orders involving the Customer.
Once the payment has been made, the Customer will receive an automatic email containing a summary of purchases and a payment summary/proforma.

  1. Delivery and execution of the agreement

The customer is now enrolled in the training or event selected by him/her, or has received his/her voucher(s) by mail for the selected products.
Did you not receive these? Always check your spam mailbox/unwanted mails, sometimes our mails end up in there. Didn't receive anything in your junk mail either? Please contact reservaties@kartinggenk.be The customer takes note that purchased products and/or services may be date related. At a minimum, there is a specific day or expiration date stated on the vouchers.

Delivery of vouchers by post may be subject to charges ( e.g. registered mail or delivery via courier service ). It is the customer's responsibility to observe a reasonable delivery time in case of delivery by post or courier services. Axion Invest cannot be held liable for defective or incorrect delivery of vouchers.
Any shortcoming regarding the delivery of an item, must be reported by the Customer immediately to AXION (reservaties@kartinggenk.be)

  1. Retention of title

The articles delivered remain the exclusive property of AXION until the moment of full payment by the Customer.
The Customer undertakes, if necessary, to draw the attention of third parties to the retention of title of AXION, e.g. to anyone who would come to seize the articles that have not yet been paid for in full.

  7. Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from AXION in their capacity as consumers. The Customer cannot exercise a right of withdrawal as it concerns the registration for an event/training (related to leisure activities) with a certain date.

  1. Customer service

  1. Sanctions for non-payment

All product purchases should always be paid immediately through the web shop.

  1. Privacy

The controller, AXION, respects the Belgian law of December 8, 1992 on the protection of privacy in the processing of personal data.
The personal data provided by you will only be used for the following purposes: the execution of the contract, the processing of the order, sending newsletters, advertising and marketing purposes. You have a legal right to access and correct your personal data. This can be done through the personal account, which you created to make a purchase through our webshop. Provided proof of identity (copy of identity card), you can make a written, dated and signed request to AXION, Damstraat 1, 3600 Genk, Belgium, marketing@kartinggenk.be, to obtain, free of charge, the written communication of your personal data. If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant.

We treat your data as confidential information and will not transfer, rent or sell it to third parties. It is possible that the personal data obtained may be passed on to companies cooperating with us: Sanmax, Apex Timing, Offimac, Adsolut
The customer himself is responsible for keeping his login data and password confidential. Your password is stored encrypted, thus AXION has no access to your password.

AXION keeps online (anonymous) visitor statistics to see which pages of the Internet site are visited to what extent. If you have any questions about this privacy statement, please contact us at marketing@kartinggenk.be .

 

  1. Use of cookies

If any provision of these Terms is held invalid, illegal or void, this shall not in any way affect the validity, legality and applicability of the remaining provisions.
The failure at any time by AXION to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

 

  1. Change conditions

 

These Terms are supplemented by other terms and conditions explicitly referred to, and the general terms and conditions of sale of Axion Invest NV. In case of contradiction, these Terms shall prevail.

 

  1. Proof
    The Customer accepts that electronic communications and backups may serve as evidence.
    AXION has subscribed to the Regulations of the UNIZO e-commerce label. A copy of these Regulations and access to UNIZO's complaints procedure is available at https://www.unizo.be/uw-webshop-juridisch-waterdicht-dankzij-het-unizo-e-commercelabel.

 

  1. Access rules and security

Motorsports can be dangerous, even resulting in death.  By my purchase or agreement, I confirm that I have read, understood and approved the rules below before entering the circuit of Karting Genk with any kart, be it my own or rental kart. 

15.1 KART RENTAL

15.1.1 Genral conditions

Karting Genk is an outdoor karting circuit and karts rental company, which appeals to the physical and intellectual skills of the participant. For your own safety and that of the other participants, you are required to attend the safety briefing. You must respect the safety rules and regulations at all times - whether written, oral, posted or communicated by Karting Genk staff. Karting Genk assumes no liability in case of incorrect data provision or violation of the following rules:

  • You must meet the minimum height and age requirements further described in these terms and conditions. Furthermore, you must have good physical condition and motor skills, be able to sit properly and use the pedals correctly.
  • Not to have heart problems/epilepsy, asthma/no weak joints/inflammation.
  • You should have a good knowledge of your own physical/mental abilities and limitations.
  • Not to take any medications that impair physical and intellectual abilities.
  • Not to be pregnant and not to have given birth less than 6 months ago.
  • If we assess that your physical and/or mental abilities are not adequate, access to the activity may be denied for your own safety.
  • Please note that in case of excessive drinking and/or drug use, access to the activity may be denied.
  • During the safety briefing (before the start of your karting session) you will always be given the necessary explanation, but please know in advance that it is forbidden:

- riding with a scarf or hood.
- riding without, or with an unattached helmet
- riding with long hair sticking out from under the helmet
- riding with flip-flops or loose shoes/heels
- start the kart yourself
- putting your hands on the kart/motor
- get off before the engine is turned off

In order for you to have the best and safest karting experience possible, here are some tips:

  • You must respect the safety rules and regulations at all times - Whether written, verbal, posted or communicated by Karting Genk staff.
  • We strongly discourage you from bringing your personal belongings (cell phone, keys, etc.) in the kart.
  • You must be careful during the karting session and be considerate of the other drivers.
  • You can end the karting session at any time (e.g. if you feel unwell) by entering the pits. Always do this in a safe manner and, if necessary, enlist the help of one of the Karting Genk rental kart staff.
  • You are obviously not alone on the track. Your (driving) behavior affects your own safety, but also the safety of the other participants, please be considerate of the other drivers on the track.
  • In case of doubt, you can always contact the staff of Karting Genk. They are ready to provide additional information or explanations if required, on top of the information and explanations given during the safety briefing on site.
  • Always stand in a safe place.

15.1.2 KIDS & FUN karts

From a length of 1m25 to 1m50 one rides in a kids kart. From a height of 1m50, one can ride a fun kart.

If a minor (-18) wishes to drive a kids or fun kart, one of the parents or the legal guardian must assess the following safety rules.

The Duo kart is available for two persons where in case of a minor, the adult will always take the wheel. Even if the minimum height of 100 cm is reached, the passenger can be refused access to the kart.

 

15.1.3 Pro Rental Karts

You must be at least 18 years old to drive a Pro kart.

You must be at least 1m50 tall, have good physical condition and motor skills, be able to sit properly and use the pedals correctly.

 

15.1.4 EXPERT Rental Karts (ROTAX MAX)
From taking possession, the renter is responsible for the kart and must take the necessary care of it. All damages, except normal wear and tear, intentionally or unintentionally caused by the driver will be recovered from the renter. In case of damage, the repair can only be done by a mechanic appointed by the lessor. The lessee agrees to pay for these damages at the moment he is requested to do so by the lessor. Even if the renter has insurance against damage, the renter will always pay the lessor and the renter will turn to his insurer for reimbursement. Reckless driving and not following the guidelines will lead to the immediate termination of this agreement without the lessor being obliged or in any way may be obliged to pay damages or refund the rental price. The renter declares to have taken note of the applicable track rules.

Following age limits are used as guidelines for the different expert karts : Senior max & DD2 from 15 years old ; Junior max from 12 years old ; Mini max: from 10 years old ; Micro max: from 7 years old.

The renter is aware that he will be driving among other kart owners. Consequently, he is not alone on the track. His (driving) behavior affects , not only his own safety, but also the safety of the other participants. Please be considerate of the other drivers on the circuit.

  1. Exoneration and refunds

AXION or its suppliers cannot be held responsible for the consequences of a slight and/or ordinary error on its part and/or its employees. AXION cannot be held responsible for the technical operation of the leased property and in case of defect or faulty operation, no damages can ever be claimed from it. In any case, the liability of AXION is limited to the amount included in the contract concluded between the parties. In addition, AXION can only be held responsible for damage directly caused by the goods supplied. In no case can AXION be held responsible for damage that occurred or was caused by careless or inexpert use of the product.

If AXION supplies products that it has obtained from a third-party supplier, it will not be obliged to provide a higher guarantee than that which the third-party supplier is obliged to provide.

Karting Genk will not make refunds for tickets or products purchased online or in case of driving times that have not been fully used up.

 

  1. Events

AXION organizes different types of events on both the FUN and PRO circuits, and with different types of karts. All participants should ensure that they have attended the briefing, either online or on-site, prior to the event.

In the case of a team entry, it is the responsibility of the person doing the entry that all participants for which he has entered receive and go through that same briefing.

In the case of an event registration, it is the responsibility of the person who booked the event that all participants for whom he has booked receive and review that same briefing

 

  1. Quatations

Quotations are without obligation, and are non-binding due to variable costs and prices.

The quotation is prepared on the basis of the data provided by the customer to AXION. AXION is not responsible for the correctness of these data.

The prices are given in euros and are always inclusive of V.A.T. and exclusive of shipping costs.

Any increase in the V.A.T. rate or any other tax of any kind between the order and the execution will be borne by the client.

Date in option : Your chosen date will be put on option for you for 2 weeks. Only upon written request can this option be extended for another 2 weeks. After this period, this date will be released again.

Confirmation : Reservation by e-mail ( events@kartinggenk.be) is mandatory. From confirmation by the customer of the chosen formula, date and timing, regardless of the execution date, Karting Genk commits to the proposed prices.

Payment :  The balance will be invoiced after execution of the services ordered or delivery of the goods ordered and based on the exact numbers you provide one week in advance. Payment term: upon receipt of invoice, unless otherwise agreed in writing.

Modification : Final numbers must be submitted in writing at least one week prior to the event date. If not, the original numbers will be maintained.

Extras/equipment rental : All additional quoted services and/or materials can be changed at the latest 14 days before execution date. Any additional costs involved will be passed on to the client. 

  1. Complaints

Complaints must be made in writing within 7 days of your visit or participation in a session or event. This can be done by mail or email to events@kartinggenk.be.  Axion Invest NV has subscribed to the Regulations of the UNIZO e-commerce label. A copy of these Regulations and access to the UNIZO complaints procedure is available via https://www.unizo.be/uw-webshop-juridisch-waterdicht-dankzij-het-unizo-e-commercelabel.
